Background
CyberU, Inc. is a licensee of the TRUSTe Privacy Program. TRUSTe is an independent, non-profit organization whose mission is to enable individuals and organizations to establish trusting relationships based on respect for personal identity and information by promoting the use of fair information practices. This privacy statement covers the site www.cyberu.com. Because CyberU wants to demonstrate its commitment to our user's privacy, it has agreed to disclose its information practices and have its privacy practices reviewed for compliance by TRUSTe.

This Web site is intended for use by those individuals that are 13 years of age and older.

EU Safe Harbor

CyberU abides by the EU Safe Harbor framework as set forth by the Department of Commerce regarding collection, use, and retention of data from the European Union.

Information Collection and Use
The following discloses CyberU's information gathering and dissemination practices for this Web site:

Information Collection
CyberU is the sole owner of the information collected on its websites offering its human capital management products, including without limitation www.cyberu.com. CyberU collects information for our users at several different points on our Web site(s).

Registration Form
In order to register for educational courses, programs and related products on this web site, you must first complete the registration form. During registration, you are required to create a username and password, and to provide us contact information such as your name, email address, and birthdate. We use this information to contact you and to identify that you are 13 years and older. We do not require you to provide a telephone number, but we use this information as an alternative way to contact you in the event of a problem with your order.

Order Form
We request information from you on our order form. You must provide us billing information such as name, email, billing address, credit card number, and expiration date. This information is used for billing purposes and to fill your order. If we have trouble processing an order, the information is used to contact the user.

Course Progress
As you register for and complete online courses, we will store this information on our system. This information includes the date registered for the course, the due date, completion status, and test scores, if available. This information is used only by you; however, we may use this information as required for troubleshooting purposes.

Passive Collection
We passively collect information about your computer hardware and software. This information may include but is not limited to: your IP address, browser type, operating system, domain name, access times, and referring Web site address. This information is used for the operation of the service, to maintain quality of the service, and to provide general statistics regarding use of our website(s), including without limitation www.cyberu.com.

CyberU also passively collects information about which pages our customers visit within our websites, including without limitation www.cyberu.com. The site visitation data is identified only by a unique ID number, and is normally not linked with personally identifiable information. However, we will combine this information with personally identifiable information to identify a visitor in order to enforce compliance with terms of service or to protect our service, site, guests, or others.

Information Use
CyberU believes that all information that we gather about you should be used solely to assist you in locating, comparing, purchasing, receiving customer service for, or registering for and/or learning about educational courses, programs and related products and services. Although other companies may seek to purchase information regarding our users, CyberU will never sell your personal information to other companies other than in aggregated form.

Cookies
A cookie is a piece of data stored on the user's hard drive containing information about the user. A cookie can last for the length of a user's session on our site (a session cookie) or for a longer time (a non-session cookie). Once a user closes her browser, the session cookie terminates. We use non-session cookies to enable our site to be customized for the user upon the user's return to our site. If a user rejects a cookie, she may still use our site but may be limited in some areas of our site. Cookies help us track and target the interests of our users to enhance their experience on our site.

Our reporting service provider, currently WebSideStory, will also use cookies to help track usage on our site. This information is not linked to any of your personally identifiable information. We use the information that WebSideStory collects to enable us to analyze trends, administer the site, track user's movement in the aggregate, and gather broad demographic information for aggregate use. Please see the section "Reporting Service Provider" below for more information.

Log Files
Like most standard Web site servers we use log files. This includes information such as your IP address, browser type, operating system, domain name, access times, and referring Web site address. This information is not normally linked to personally identifiable information and we normally use this information to enable us to administer the site, diagnose problems with our server, and measure server performance.
However, we will combine this information with personally identifiable information to identify a visitor in order to enforce compliance with terms of service or to protect our service, site, guests, or others.

Web Beacons
Our third party reporting service provider, currently WebSideStory, employs a software technology called clear gifs (a.k.a. Web Beacons/Web Bugs), that help us better manage content on our site by informing us what content is effective. Clear gifs are tiny graphics with a unique identifier, similar in function to cookies, and are used to track the online movements of Web users. The main difference between the two is that clear gifs are invisible on the page and are much smaller, about the size of the period at the end of this sentence. Clear gifs are not tied to your personally identifiable information.
WebSideStory uses clear gifs to help track usage on our site. This information is not linked to any of your personally identifiable information. We use the information that WebSideStory collects to enable us to analyze trends, administer the site, track user's movement in the aggregate, and gather broad demographic information for aggregate use. Please see the section "Reporting Service Provider" below for more information.

Email Communication
You may receive email communication from CyberU in the following circumstances:

  • To confirm that you have registered with CyberU;
  • To confirm that you have registered for a course or program;
  • To send you instructions on how to take a registered course on a third-party course provider;
  • To reply to emails sent by you to us in regards to your account;
  • To inform you about CyberU and related products and services, if you so request; and
  • To notify you about changes made to the Terms of Service and/or Privacy Policy.

Choice/Opt-in/Opt-out
Out of respect for the privacy of our users, CyberU will only send you the information relating to CyberU and related products and services above for marketing purposes only if you have opted to receive the information during the registration process. If you change your mind whether to receive this information, we offer an opt-in/opt-out mechanism on the "My Account" page located at http://www.cyberu.com/user_register.asp.

Sharing

Legal Disclaimer
CyberU may disclose personal information without your consent when required by law or in the good-faith belief that such action is necessary in order to conform to the edicts of the law or comply with a legal process served on our Web site.

Aggregate Information
CyberU may share aggregated statistical information gathered from the registration process with advertisers, business partners, sponsors or other third parties, but none of them receive individual identifying information about you collected at our sites. For example, we may tell an advertiser that X number of visitors visited a certain area on a Web site but we would not disclose anything that would identify those individuals. We share this information only on an aggregate, anonymous basis and never on an individual basis, except as otherwise provided for in this privacy policy.

Third Party Intermediaries

Credit Card Processor
On the order form, we do not keep a copy of the billing information you provide us; instead, we immediately pass this information to our payment processor, currently Verisign Payment Services, to process your order, and will only use this information for this purpose. Verisign's privacy policy can be found at http://www.verisign.com/truste.

Third-party Course Service Providers
Occasionally, CyberU's Course Providers elect to serve their course or curriculum by themselves. When you sign up for these particular services, we will share your name and email address in order to facilitate delivery of these courses. If your course is being delivered by a third party, you will receive a pop-up window warning you that this will happen.

Once you have accepted this warning, you will be transferred to the other provider. CyberU expressly disclaims any responsibility for the privacy practices or the content of such other Web sites, and content providers, and CyberU urges you to read and become familiar with the privacy practices of the other sites and content providers that you may visit as a result of visiting the CyberU site.

In addition to the purposes above, upon receipt of refund requests or difficulties using third party content, whether served by us or by the course provider, CyberU may share your personally identifiable information with the applicable content provider.

Reporting Service Provider
CyberU uses a third party reporting service provider, currently WebSideStory, to collect anonymous usage statistics on our Web site. WebSideStory uses cookies and web beacons to collect these usage statistics. WebSideStory does not collect any of your personally identifiable information. These usage statistics are not linked to personally identifiable information. Through the use of technology, you may be able to limit the information collected by WebSideStory. WebSideStory's privacy policy can be found at http://www.websidestory.com/privacy.

This site contains links to many other Web sites. CyberU expressly disclaims any responsibility for the privacy practices or the content of such other Web sites, and CyberU urges you to read and become familiar with the privacy practices of the other sites that you may visit as a result of visiting the CyberU site(s).

eMail a Friend
CyberU will send your friend one email per request per email address provided. The CyberU Web site neither stores the email address of the friend nor shares the email address with any third party.

Security
CyberU takes all precautions it deems reasonable to protect your information. When you submit sensitive information via the CyberU Web site, your information is protected both online and offline.

When our registration and/or order form asks you to enter sensitive information, that information is encrypted and is protected with encryption software known in the industry a Secure Socket Layer (SSL). While on a secure page, such as our schedule (registration) and/or enrollment (order) forms, the lock icon on the bottom of Web browsers such as Netscape Navigator and Microsoft Internet Explorer becomes locked, as opposed to un-locked, or open, when you are just "surfing" the web.

While we use SSL encryption to protect sensitive information online, we also take precautions that we deem reasonable to protect user-information off-line. Generally, only employees and other agents who need the information to perform a specific job are granted access to personally identifiable information. In order to access such information, employees are generally required to use confidential passwords. In addition, the servers that we store personally identifiable information are physically located in a highly-secure third-party managed hosting facility that is continuously monitored, or in a locked isolated room at our corporate headquarters.

Correction/Updating Personal Information

If a user's personally identifiable information changes (such as your email address or telephone number), CyberU provides a way to correct/update your information. This can be done three different ways:

1) Clicking on "[name of user] schedule" on any page at the CyberU website and then by clicking on "Edit Profile";
2) emailing our Customer Support at support@cyberu.com; We will respond to your request within 30 days; or
3) contacting our customer support at (310) 752-0130.

Notification of Changes

If we decide to make material changes to our privacy policy, we will prominently post those changes on our homepage so our users are always aware of our current privacy policy. If at any point in time we decide to use personally identifiable information in a manner different from that stated at the time it was collected, we will attempt to notify you by way of an email. You will have a choice as to whether or not we use their information in this different manner.
